By accessing or using Clair, operated by Momentumism Inc. ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

Description of Service

Clair is a voice-first AI thinking partner that helps professionals articulate, refine, and publish ideas for personal branding and thought leadership. Our service includes voice conversations, AI-generated content drafts, and content management tools.

Eligibility

You must be at least 18 years old to use Clair. By using our service, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• One account per person — you may not share accounts.

SMS and Phone Communications

By providing your phone number and opting in to SMS communications, you consent to receive text messages from Clair / Momentumism Inc., including:

• Notifications about your scheduled calls and content sessions
• Reminders and follow-ups related to your use of the service
• Transactional messages related to your account

Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any regulations
• Generate content that is defamatory, harassing, or infringes on third-party rights
• Attempt to reverse engineer, hack, or disrupt the service
• Use the service to spread misinformation or impersonate others
• Resell or sublicense access to the service without our written consent

Intellectual Property

Your Content: You retain ownership of the ideas and content you bring to Clair. By using our service, you grant us a limited license to process your content solely to provide the service.

Our Platform: The Clair platform, including its design, software, and underlying technology, is owned by Momentumism Inc. and protected by applicable intellectual property laws.

Disclaimer of Warranties

Clair is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or produce any particular outcome for your personal brand or career.

Limitation of Liability

To the maximum extent permitted by law, Momentumism Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the service.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from your account settings. Upon termination, your right to use the service ceases immediately.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the service. Continued use after changes constitutes acceptance of the new terms.
